The following terms and conditions apply to your purchase of products at Olive Audio GmbH (Olive). By placing your order, you agree to be bound by these terms and conditions, which constitute the entire agreement between you and Olive regarding the product(s) purchased.
Your order is subject to acceptance by Olive and may be refused for any reason, including credit concerns, unusual volumes or shipping addresses. Once accepted, Olive may make partial shipments if some items are on backorder. By placing the order you agree that Olive may do so and charge you for any items shipped.
The price for each product purchased is reflected on your order and will remain the price regardless of any subsequent price changes by Olive. ATTENTION: Special duties/taxes might apply to products shipped to different countries. Those taxes will not be reflected in your Olive order confirmation.
Orders may be canceled up to the actual shipment date, which may differ from the estimated shipment date provided by Olive. Order cancellations are only effective if confirmed by Olive in writing.
Payment in full is due prior to shipment. Olive will only accept payment via credit card and PayPal. You will not be charged until Olive ships your product(s) to you.
In most countries Olive does not charge additional fees for shipping and tax. if additional fees apply, you will pay shipping and handling charges in addition to the quoted product price. You will only be charged one shipping and handling charge for each order regardless of the number of shipments. Olive will ship products according to your selected shipping instructions. Olive will attempt to ship the products within the estimated times reflected on your order but will not be liable for any failure to do so. If Olive learns it cannot ship within the estimated times, you will be advised via email or regular mail. For items on backorder, Olive may ship whenever the product becomes available without any notice to you. Order cancellations are only effective if confirmed by Olive in writing.
Title to all products passes to you upon delivery of the product to the selected carrier.
If you are not completely satisfied with your Olive product at any time during the 30-day period following the date you received your product delivery, please contact Olive at email@example.com. Please note that only products in the original packaging with all materials and in new or as-new condition are eligible for the 30-Day refund.
Please follow the steps below for a refund of your purchase price.
A) Request a RMA
Every return must have an associated Return Merchandise Authorization (RMA) number. A RMA may be obtained from Olive at firstname.lastname@example.org. Olive must receive the returned item within fourteen (14) days after a RMA number has been issued. An assigned RMA number is valid for 14 days only and will expire on the 15th day after the date of issuance, at which time any returned products may be refused.
B) Use the Original Olive Packaging
All products must be returned in the original packaging with all contents included. Please note that failure to return all items included with your product, or returning the product without the manufacturer packaging may result in the product(s) being shipped back to you at your own expense or a reduced refund issued to your account.
C) Ship the Product Back to Us
Once you have received your RMA number, please write it clearly on the outside of the package to be returned. Please ensure that previous shipping labels or other markings have been removed or covered completely. It is the customer's responsibility to arrange shipment pickup, prepay shipping (and any duty) charges, and insure the shipment or accept the risk if the product is lost or damaged in shipment. We advise that you ship the product back to us via UPS, DHL or FedEx to ensure proper delivery. It is the customer's responsibility to retain a sender's copy of the shipment invoice and the shipment tracking number in the event of a lost shipment until the return product has been received. Olive reserves the right to refuse any product returned that does not meet these criteria.
D) Email Your Return Shipment Tracking Number to email@example.com
Please include "Shipment Notification: RMA# (please include your RMA# here)" in the email subject line and the returns shipment tracking number and the time of pick-up in the email body.
E) Receive Your Refund
Once the return is received and verified to meet all of the above conditions, please allow 10-15 business days from the date of receipt for the credit to appear on your account. Credit will be issued to the payment method or credit card used for your original purchase only. Olive will not refund original or return shipping costs or duties. If you received free shipping during the holiday promotion and return your product at a later date, your refund will be reduced by the cost that Olive incurred for the original shipment of your product(s) to you.
> If your returned product is not in original packaging, does not contain all accessories or is not in new or as-new condition, it is not eligible for return under the 30-Day money back policy. Customer is responsible for all costs to bring products back into sellable condition,and authorizes Olive to deduct costs from refund amount to be issued to customer's payment method.
If your product is not functioning properly or is damaged upon arrival please contact our Technical Support Department at firstname.lastname@example.org as soon as possible (but no later than 7 days from receipt of your shipment). In most instances, our highly skilled Tech Support representatives can assist you in diagnosing and resolving your product problems. However, in rare instances, a product is defective. Olive warrants its hardware products against defects in materials and workmanship for a period of six (6) months from the date of original retail purchase.
If a defect exists, Olive will, at its option:
(1) Repair the product at no charge, using new or refurbished replacement parts, or
(2) Exchange the product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original product. A replacement product assumes the remaining warranty of the original product, or 90 days, whichever provides greater coverage. When a product or part is exchanged, any replacement item becomes your property and the replaced item becomes the property of Olive.
All products returned to us must be accompanied by a valid Return Authorization (RA) number issued by us. RAs expire 15 days after they are issued and cannot be extended or re-issued. A valid RA number must be written clearly and conspicuously on the outside of the packaging. After assessing the issue you are experiencing and authorizing a RA, Olive will determine who is responsible for paying the shipping costs associated with the product repair. Unauthorized returns will be refused.
Exclusions from warranty: Damage which cannot be attributed to defects in materials and workmanship is not covered by warranty (e.g. damage through negligent handling or use of excessive force). In rare circumstances products are damaged during shipping. If your Olive product is delivered with damage that is not covered by warranty, please report it to Olive immediately, but in no case later than 7 days after delivery. Damages reported after 7 days will not be eligible for repair/replacement.
Damage that is not covered by warranty includes, but is not limited to: Scratches or other physical damage of enclosure Scratches, cracks or other physical damage of LCD Physically broken or bent INPUT and OUTPUT ports
THE REMEDIES PROVIDED HERE ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF THIS AGREEMENT BY OLIVE. IN NO EVENT WILL OLIVE BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES. IN NO EVENT WILL OUR LIABILITY TO YOU EVER EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU TO OLIVE FOR THE PRODUCTS PURCHASED.
This agreement is governed by German law. Olive is not responsible for typographic errors. Olive reserves the right to change these terms or the prices charged at any time so please check each time you purchase. Disclaimer: Olive makes no warranty, either expressed or implied, including without limitation, any warranty of merchantability or fitness for a particular purpose. Olive shall have no liability to you or any third party for special, incidental, indirect, exemplary or consequential damages or any other economic hardship arising out of the use of or inability to use the products, and in all cases our liability is limited strictly to replacement, or repair or the value of the products purchased. State laws vary and certain parts of this disclaimer may not apply to you. We reserve the right to make adjustments or corrections due to changing market conditions, product discontinuations or typographical or photographic errors in advertisements or product descriptions. Policies, item availability and prices are subject to change without notice. We reserve the right to limit quantities on certain items. Please remember to back up all your data before installing any new hardware, software or peripherals; we are not responsible for any lost data.
How We Protect the Security of Your Information
We employ the latest encryption and security technology and fraud detection techniques in all areas of our online store where you provide us with personal or account information. This is done to protect you from unauthorized use of the information you are sending to our server. To make sure you have the latest security features on your browser, download and install the latest version of your favorite browser, Microsoft internet Explorer or Netscape Communicator. For privacy purposes, once you give us any information relating to you, it is stored on a highly secure server that is not accessible via the internet.
What Information Do We Collect from You?
When you visit our Web site, our server automatically recognizes your internet Protocol address (IP address) or domain name. In order to enhance our Web site, we may track the way our visitors and customers are using the site. Personal information, such as your name and e-mail address, is not included in this analysis. Unless you provide it, we do not collect or know your name or e-mail address. We do not follow your browsing path outside of our online store. When you place an order, request a download, sign up for our Olive newsletter or participate in a promotion or contest, we ask you to provide information including your name, postal address, e-mail address and, in the case of product orders, credit card number. Except to verify credit card information to complete your order, we do not use or release any credit card or financial information for any purpose.
How do we Use the Information We Collect?
If you provide us with your postal address, e-mail address or telephone number, you may receive Olive promotional mailings, e-mails or telephone calls. If you receive e-mail from us that you would rather not receive, simply send us an e-mail containing your exact e-mail address in the body text at or follow the unsubscribe instructions set forth at the bottom of each e-mail. If you do not wish to receive our promotional material or telephone calls, please write to . We will be happy to respect your request not to participate in our direct marketing programs.
